1. Acceptance of Terms

By accessing or using the website ApexCoverageGroup.com (the "Site") operated by Apex Coverage Group LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.

2. Description of Service

Apex Coverage Group is a lead generation service that connects consumers seeking auto insurance with licensed insurance agents, brokers, and carriers ("Insurance Partners"). We are not an insurance company, agent, or broker. We do not sell, bind, or underwrite insurance policies. Any insurance policy you purchase will be through a licensed Insurance Partner.

3. Lead Generation & Data Sharing

By submitting a quote request through the Site, you understand and agree that:

• Your information will be shared with one or more Insurance Partners for the purpose of providing insurance quotes
• Multiple Insurance Partners may contact you based on your submission
• We are compensated by Insurance Partners for connecting them with consumers
• Submitting a quote request does not guarantee you will receive a quote, policy, or specific rate

4. TCPA Consent & Communications

By submitting the quote form and providing your express written consent, you agree to receive communications as described in the consent language on the form, including:

• Autodialed and/or prerecorded telephone calls and text messages (SMS/MMS) to the phone number(s) you provide
• Email communications to the email address you provide
• Communications from both Apex Coverage Group and our Insurance Partners

You understand that consent is not a condition of purchase. Standard message and data rates may apply. Message frequency varies. You may revoke consent at any time by replying STOP to any text message, emailing info@apexcoveragegroup.com, or calling (888) 000-0000.

5. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Site and submit a quote request. By using the Site, you represent and warrant that you meet these requirements.

6. Accuracy of Information

You agree to provide accurate, current, and complete information when submitting a quote request. Providing false or misleading information may result in the inability to obtain an accurate quote or insurance policy.

7. No Insurance Advice

Nothing on this Site constitutes insurance advice, financial advice, or a recommendation to purchase any particular insurance product. You should consult with a licensed insurance professional before making any insurance decisions.

8. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Apex Coverage Group LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX COVERAGE GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless Apex Coverage Group LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

11. Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site (each, a "Dispute") shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.

You and Apex Coverage Group agree that:

• All Disputes shall be resolved through arbitration and not in court (except for claims that may be brought in small claims court)
• Arbitration shall take place in Sheridan, Wyoming, or at another mutually agreed location, or may be conducted remotely
• The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction
• CLASS ACTION WAIVER: All Disputes must be brought in an individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Outbound Communications

By submitting a quote request through the Site, you consent to receive outbound telephone calls, including calls made using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice messages, from Apex Coverage Group and its licensed insurance partners. These calls may be for the purpose of providing insurance quotes, following up on your inquiry, or offering related products and services. You understand that your consent extends to communications from both Apex Coverage Group and the third-party insurance agents, brokers, and carriers with whom your information is shared.

16. Call Recording

You acknowledge and consent that telephone calls between you and Apex Coverage Group or its representatives may be recorded for quality assurance, training, and compliance purposes. By continuing a telephone conversation with us, you consent to such recording.

17. Do Not Call Rights

You have the right to request placement on our Internal Do Not Call List at any time. We honor the National Do Not Call Registry and comply with the Telephone Consumer Protection Act (TCPA) and the Telemarketing Sales Rule (TSR).
